Before you begin, please take note of the terms of use and warnings associated with the use of our chatbot. Your interaction with our virtual assistant implies acceptance of these guidelines. Make sure to read them carefully for an optimal experience.

1. Forword

The Chatbot described here, based on ChatGPT technology developed by Open AI, was designed by EDSI-Tech Sàrl, which can be contacted at the following address: contact@edsi-tech.com
The present general terms of use (GTU) rule the use of Chatbot by the Client and the User. The present GTU may be modified at any time. The Client will be informed of any modifications as soon as possible.
By using and placing the Chatbot on its platform, the Client and the User are deemed to have read and accepted the present GTU.

2. Definitions

  • Chatbot: a service tool developed and based on ChatGPT technology by the Publisher and made available on the Client's platform.
  • Client: the individual or legal entity that will make the Chatbot available to Users (here : Nendaz Tourisme)
  • Publisher: the company EDSI Tech Sàrl based in Lausanne
  • Services: Information and other services provided by Chatbot
  • User: individual who uses Chatbot.

3. Use of Chatbot

Our Chatbot is based on the artificial intelligence of the company OpenAI. It has been developed using tourism data specific to the region.
The Chatbot is in constant learning evolution, with a view to enhancing its Services.
The services and advice given by the Chatbot are purely indicative and do not replace any professional advice in any way. It is highly recommended to verify the information given directly with the service providers concerned, especially regarding opening times, availability, access, prices, or accommodation possibilities within the region.
Any use of the Chatbot that contravenes current legal provisions is prohibited.
It is forbidden to attempt to interfere with Chatbot or the Services in any way that would impair, damage or overload Chatbot.
The User undertakes not to cause any prejudice to the Chatbot Publisher by use of the Services, or in any other way whatsoever.

4. Third-party Content

Content coming from a third-party or from a third-party site is given for information purposes only. The use of services or third-party sites is subject to the conditions of use of that third-party.
In no circumstances is the Publisher of the Chatbot responsible for the contents displayed by a third-party, or from hypertext links leading to third-party content.
The Publisher is in no way responsible for any content taken by or supplied to the User.

5. Responsibility

The services provided by the Chatbot are for reference only. The information provided cannot be considered as professional advice. The Publisher and the Customer decline all responsibility in connection with Chatbot, regarding the content of the Services provided by Chatbot, or actions taken based on the information provided.
No guarantee is given as to the accuracy, content or completeness of the information displayed, or as to its reliability or up-to-dateness.
The Chatbot and its Services are in principle available and at the disposal of the Customer and Users. However, the Publisher does not guarantee any availability of the Chatbot or the Services. The Publisher shall not be held liable for any interruption of access, overload of the Chatbot or the network, closure of the Chatbot or any damage whatsoever resulting therefrom.
Interruption of access or suspension of the Services provided may occur due to technical problems or maintenance and will not give rise to any compensation on the part of the Publisher.
The Publisher shall not be held liable in any way in the event of circumstances beyond its control.

6. Intellectual property

The Chatbot and the databases it contains are the exclusive property of the Publisher.
Any use, reproduction, copy or provision of the Chatbot or Services by a third party is strictly forbidden without the Publisher's authorization.

7. Legal notice

Communication with the Chatbot may be recorded in order to improve its operation and provide the Services.
By using the chatbot, Users consent to the gathering and processing of the data they transmit. In addition to this data, the Chatbot may process the following technical data:

  • IP Address;
  • Date and time of the request;
  • Time zone differences with GMT;
  • Request content;
  • Access status / code status http;
  • Amount of data transmitted;
  • Internet platform from which the request was made.

Unless otherwise agreed by the Publisher, the User and the Customer are bound by the terms of these GTU.
In the event of any clause of the GTU being deemed null, inapplicable, or invalid, the Publisher, the Client and the User declare the remainder of the GTU to be fully applicable.
Ineffective or invalid clauses will be replaced by one or more legally valid provisions whose content is as close as possible to those clauses. The ineffectiveness and/or incompleteness of a provision shall not affect the validity of the remaining provisions.
The Publisher reserves the right to modify unilaterally and without notice the content of third parties provided by Chatbot, as well as access to Chatbot by a User.

8. Applicable law and place of jurisdiction

The present GTU are governed exclusively by Swiss law.
Any dispute arising in connection with these GTU shall be submitted to the exclusive jurisdiction of the Publisher's headquarters.
